Terms of Sale

The service is currently in a free private alpha. No payment is collected and no sale takes place. These Terms of Sale will apply once the service is offered for a fee; the paid-specific provisions below (price, payment, right of withdrawal) take effect at that point.
1Purpose & Scope
These Terms of Sale (CGV) govern the subscription to the Trainsphere paid service between the seller (identified below) and any consumer acting for purposes outside their trade or profession. By subscribing, the customer accepts these CGV in full. They complement the Terms of Use (CGU) and the Privacy Policy.

3Service Description
Trainsphere provides AI-powered personalised fitness coaching delivered via WhatsApp, Telegram and a web dashboard: personalised workout programmes, daily coaching, progress tracking and adaptive adjustments. The service is a coaching service and does not constitute medical advice (see the Terms of Use, Health Disclaimer).
4Price
- Monthly plan: 59 € per month.
- Annual plan: 588 € per year (equivalent to 49 € per month).
- Prices are shown net of VAT (VAT not applicable, Art. 293 B CGI) and are payable in advance for each period.
- The seller may change prices at any time; the price applicable is the one displayed at the time of subscription. Any price change applies to subsequent renewal periods, with prior notice.
5Order & Formation of the Contract
The customer selects a plan, reviews the order summary and price, and confirms payment. The order is firm once payment is confirmed. A confirmation is sent by email. The contract is concluded for the chosen period and renews by tacit agreement (see Duration & Cancellation).
6Payment
Payment is processed securely by our payment provider Stripe Payments Europe Ltd. The seller never receives or stores card data. Payment is taken at subscription and then automatically at each renewal. In the event of payment failure, access may be suspended until the situation is resolved.
7Duration, Renewal & Cancellation
- The subscription is concluded for the chosen period (monthly or annual) and renews automatically for the same period unless cancelled.
- The customer may cancel at any time, by the same easy electronic means used to subscribe (Art. L215-1-1 of the Consumer Code), from Account Settings. Cancellation stops the next renewal; access continues until the end of the period already paid.
- For tacit renewal of contracts concluded with consumers, the seller informs the customer of the renewal and of the right to cancel under the conditions of Article L215-1 of the Consumer Code.
- No refund is due for a period already started, subject to the statutory rights and the commercial guarantee below.
8Right of Withdrawal (14 days) & Express Waiver
Because this is a distance contract, the consumer normally has 14 days to withdraw without reason (Art. L221-18 of the Consumer Code).
- Digital service with immediate access: at checkout, the customer expressly requests that performance begin immediately, before the end of the 14-day period, and expressly acknowledges that they will lose their right of withdrawal once the service has been fully performed (Art. L221-28, 1° of the Consumer Code).
- If the customer withdraws within 14 days while the service has only been partly performed, they owe an amount proportionate to the service supplied up to the withdrawal (Art. L221-25).
- Where no immediate-execution waiver has been given, the customer may withdraw within 14 days and obtain a full refund within 14 days of being informed of the decision.

9Commercial Guarantee — 7-Day Money-Back
In addition to the statutory rights, the seller offers a commercial “satisfied or refunded” guarantee: a full refund of the first payment if requested within 7 days of the first subscription. This guarantee is available once per email address; subsequent subscriptions from the same email are not eligible. It does not reduce the statutory rights described above.
10Statutory Guarantees
The customer benefits from the legal guarantee of conformity for digital content and services (Art. L224-25-1 et seq. of the Consumer Code) and, where applicable, from the guarantee against hidden defects (Art. 1641 et seq. of the Civil Code). These guarantees apply independently of any commercial guarantee.
11Complaints & Consumer Mediation
- Any complaint should first be addressed to the seller at contact@trainsphere.io.
- Failing a satisfactory resolution within one month, the consumer may refer the dispute free of charge to the consumer mediator: [MEDIATOR_NAME], [MEDIATOR_ADDR] — [MEDIATOR_URL].
12Liability
Trainsphere is a fitness coaching service, not medical advice. The seller's liability cannot be engaged for the consequences of an inappropriate use of the recommendations or for pre-existing medical conditions not disclosed. Nothing in these CGV excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. The statutory guarantees remain fully applicable.
13Personal Data
Personal data collected for the sale and the service is processed as described in the Privacy Policy. Privacy Policy.
14Governing Law & Disputes
These CGV are governed by French law. The consumer may bring proceedings before the courts having jurisdiction under the applicable rules, including the courts of their place of residence. This does not deprive the consumer of the protection afforded by mandatory provisions of the law of their habitual residence.
